Equal Employment Opportunity

The policy of Berkel & Company Contractors, Inc. is that equal employment opportunity shall be afforded to all qualified persons with no regard to race, color, creed, sex, national origin, age, disability, marital status, sexual orientation, veteran status, citizenship status or any other protected group status. This applies to recruitment, hiring, compensation, benefits, training, promotion, demotion, transfer, lay-off or termination of our employees and it is our intent to comply with Executive Order No. 11246 as it relates to Equal Employment Opportunity, as amended. This policy extends to every phase of employee recruitment, such as employment agencies, labor organizations, and advertising.

When hiring employees through the local unions or employment agencies, a written request will be submitted asking for minority workers with particular emphasis being placed on the more skilled crafts, such as Operating Engineers. Further, we will aggressively seek to employ minority trainees wherever possible and again request their employment when ordering help from the unions or employment agencies.

Due to the short duration of our projects and the wide geographical expanse of our working area, a formal training program is prohibitive. However, every effort will be made to actively recruit those minority employees who express a willingness to learn and a desire to travel. We do make an effort to engage the assistance of such minority organizations as the Kansas City Plan and similar organizations in other cities, in order to recruit skilled minority employees.

An equal opportunity poster shall be displayed in our main office, each regional office, and on any jobsite where facilities are available for appropriate placement of such.

Non-Discrimination in Equal Opportunity Policy, it is further the policy of Berkel & Company to cooperate to the fullest extent with the applicable regulations of the Civil Rights Act of 1964, Executive Order No. 11246, as amended. This policy pertains, so far as the responsibility of this Company is concerned, to any arrangement under which employees, including apprentices and trainees, are selected or referred for work.

Women shall not be penalized in their conditions of employment because they require time away from work on account of childbearing. Childbearing will be considered to be a justification for leave of absence for a female employee for a reasonable period of time. Following childbirth, and upon signifying her intent to return within a reasonable time, such female employee shall be reinstated to her original job or to a position of like status and pay without loss of service credits.
